Welcome to FlexWork.ge (“FlexWork”,
“Platform”, “Website”, “we”, “us”, “our”).
FlexWork.ge is an online freelance marketplace that
connects Clients seeking services with Freelancers offering
professional services. By accessing or using
the Platform, you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree with these Terms, you must not use
FlexWork.ge.
· User – any registered
individual or entity using the Platform.
· Client – a User who posts
jobs and hires Freelancers.
· Freelancer – a User who offers
services and applies to jobs.
· Job / Project – a task or work
posted by a Client.
· Interest – a proposal
submitted by a Freelancer to a Job.
· Contract – an agreement
created on the Platform between a Client and a Freelancer.
· Points – virtual credits
purchased and used on the Platform.
· Content – any text, images,
files, messages, or data uploaded to the Platform.
1.
Users must be at least 18 years old to register.
2.
Users must provide accurate and complete information.
3.
Email verification is required to access certain features.
4.
Each User may maintain only one account, unless explicitly approved by
FlexWork.
5.
FlexWork reserves the right to suspend or terminate accounts
that violate these Terms.
FlexWork.ge
is not an employer,
agency, broker, or party to any contract between Clients
and Freelancers.
· FlexWork provides tools, infrastructure, and visibility
only.
· All work agreements,
communications, deliverables, and payments are the sole responsibility of the
Users.
· FlexWork does not guarantee job success, payments, or
quality of work.
FlexWork
operates using a Points-based
access system.
· Points are virtual, non-refundable,
and non-transferable.
· Points have no real-world monetary value outside
the Platform.
· Points are required to
unlock or access certain features.
Both
Clients and Freelancers may purchase Points through the Platform.
· Prices and packages are
displayed before purchase.
· All purchases are final.
· FlexWork is not
responsible for unused Points.
Freelancers
use Points to:
1.
Submit interest (apply) to jobs
2.
View restricted Client information (if applicable)
The
cost in Points may depend on:
· Job budget
· Number of existing
interests
· Platform-defined dynamic
rules
If
a Freelancer does not have sufficient Points:
· They cannot submit interest to
that Job.
Clients
may use Points to:
· Publish jobs
· Access premium features
· Unlock extended Freelancer
details (if applicable)
1.
Clients may post jobs with descriptions, budgets, timelines, and
requirements.
2.
Jobs may be:
o Open
o Active
o Completed
3.
Completed jobs may remain visible for transparency and portfolio
purposes.
4.
Freelancers cannot
submit interests to completed jobs.
1.
A Freelancer may submit only one interest per job.
2.
Submitted interests include:
o Proposed budget
o Estimated duration
o Optional message
3.
Submitting an interest consumes Points.
4.
Submitted Points are not
refunded, regardless of selection outcome.
1.
A Client may select only
one Freelancer per Job.
2.
Once selected:
o A Contract is created
o Other Freelancers are
marked as “Not Selected”
3.
Contract statuses include:
o Active
o Submitted
o Completed
o Paid
4.
FlexWork does not
interfere in contractual terms.
1.
Reviews can only be submitted after a Contract is marked Completed.
2.
Each party (Client and Freelancer) may submit one review per contract.
3.
Once submitted:
o Reviews cannot be edited or deleted.
4.
Duplicate reviews are not allowed.
· Reviews are publicly
visible on user profiles.
· Users can always view
their own past
reviews.
· Reviews contribute to
public ratings and reputation.
Clients
have the right to:
· Post jobs
· Select Freelancers
· Accept or reject submitted
work
· Leave reviews
· Manage job visibility
Freelancers
have the right to:
· Browse public jobs
· Submit interests (with
sufficient Points)
· View their submitted
proposals
· Complete contracts
· Leave reviews
Users
must NOT:
· Circumvent the Points
system
· Share contact details to
bypass Platform rules
· Harass or abuse other
Users
· Post false or misleading
information
· Attempt off-platform
agreements before contract completion
· Use bots, scrapers, or
automation
Violation
may result in:
· Suspension
· Permanent account
termination
· Loss of Points without
refund
· Users retain ownership of
their Content.
· By uploading Content,
Users grant FlexWork a non-exclusive,
worldwide, royalty-free license to display and use it on
the Platform.
· FlexWork may remove
content that violates these Terms.
· FlexWork does not handle escrow or direct payments between
Users (unless explicitly stated).
· All financial agreements
are handled externally between
Client and Freelancer.
· FlexWork bears no responsibility for
non-payment, disputes, or chargebacks.
To
the maximum extent permitted by law:
· FlexWork is not liable
for:
o Lost profits
o Data loss
o Contract disputes
o User misconduct
· Total liability shall not
exceed the amount paid by the User to FlexWork in the last 12 months.
FlexWork
may suspend or terminate accounts:
· For violation of Terms
· For fraudulent behavior
· For inactivity
· At its sole discretion
Users
may terminate their account at any time.
Use
of the Platform is also governed by our Privacy Policy, which explains how personal
data is collected and processed.
These
Terms shall be governed by and interpreted in accordance with the laws of Georgia.
Any
disputes shall be subject to the exclusive jurisdiction of Georgian courts.
FlexWork
reserves the right to update these Terms at any time.
Continued
use of the Platform after changes constitutes acceptance of the updated Terms.
